Changes made directly by a client or another third party to a website after our work has been completed may affect functionality and may require additional work.

10. Digital Marketing and SEO

Digital marketing and SEO services are intended to improve online visibility, traffic, engagement and business opportunities.

However, we do not guarantee:

  • Specific search engine rankings
  • A specific number of visitors
  • A specific number of leads
  • A specific number of sales
  • A specific return on advertising spend
  • Approval of advertising campaigns by third-party platforms

Results can be affected by competition, market conditions, advertising platforms, search engine algorithms, client actions and other factors outside our control.

11. Website Content

Unless specifically included in the agreed scope, clients are responsible for ensuring that business information, product information, legal documents, images and other content supplied for publication are accurate and legally compliant.

We are not responsible for legal compliance of client-supplied content unless this has been expressly agreed as part of our services.

12. Intellectual Property

Unless otherwise agreed in writing, intellectual property rights in materials supplied by the client remain with the client or the relevant rights holder.

Upon full payment, the client will generally receive the rights to the final project deliverables specifically created for them, subject to any third-party licences, platform terms, open-source licences or other applicable restrictions.

Third-party themes, plugins, applications, stock assets, fonts, software and other licensed materials remain subject to their respective licence terms.

We may retain ownership of pre-existing tools, systems, code, methods, templates, frameworks and know-how used to create a project unless otherwise agreed in writing.

13. Portfolio and Promotional Use

We will not assume that client work may be displayed publicly.

If we wish to use a completed project as a portfolio example, case study or promotional material, we may request the client’s permission where appropriate.

14. Website Access and Security

Clients are responsible for maintaining the security of their own hosting, domain, Shopify, WordPress and other third-party accounts.

Clients should use secure passwords and appropriate account security measures.

We are not responsible for security issues caused by compromised client accounts, unauthorised access, third-party services or changes made by parties outside our control.

15. Revisions

The number and type of revisions included in a project will be stated in the relevant quotation or proposal.

Additional revisions or changes outside the agreed scope may be charged separately.

16. Cancellation and Termination

Either party may request to end a project or ongoing service arrangement in accordance with the applicable agreement.

If a client cancels a project after work has started, the client may be responsible for payment for work already completed and any non-refundable third-party costs incurred on their behalf.
